Public Utility Regulatory Policies Act of 1978 (PURPA)

Definition: The Public Utility Regulatory Policies Act of 1978 (PURPA) enables "qualifying facilities" (QFs) to provide power to utilities. QFs were intended to increase production of renewable energy and cogeneration.

Although PURPA is federal law, states and local governing boards are responsible for implementing its provisions.

The Energy Independence and Security Act of 2007 (EISA 2007) and the Energy Policy Act of 2005 (EPACT 2005) added “states must consider” provisions to various aspects of PURPA.
